Beta terms of service

Banana Dialer is provided by Modern Apex Strategies LLC. These terms apply to business use of the website and prospecting workspace. If you use the workspace on behalf of an organization, you must have authority to do so.

Accounts and access

You must be at least eighteen years old, provide accurate account information and protect your sign-in credentials. Workspace owners are responsible for the users they invite and the access they grant. Tell us promptly if you believe an account or integration credential has been compromised.

The beta service

Banana Dialer organizes prospect records, call notes, outcomes, pipeline activity and follow-ups. Some features require separate provider accounts. The product is in beta and may change as it is tested and improved. A product demonstration uses sample information and is not evidence of a customer result.

The workspace does not include a phone number, phone service or calling minutes. Connected calling, discovery, AI and messaging providers are subject to their own availability, setup requirements, terms and charges.

Responsible use

You are responsible for the information you add, your communications and the permissions needed to use them. Do not use the product to:

• Break applicable laws or a connected provider's terms.
• Send deceptive, harassing or otherwise unlawful communications.
• Ignore a recipient's opt-out or other applicable contact restrictions.
• Access another workspace or bypass account, usage or security controls.
• Upload information that you do not have the right to process.
• Resell or white-label the service without a separate agreement.

The workspace does not determine whether a particular call or message is lawful. You are responsible for checking the requirements that apply to your outreach and reviewing generated suggestions before use.

Customer information

You retain your rights in the information you provide. You authorize Modern Apex to host, process and transmit that information as needed to provide the service and integrations you request. Our privacy policy describes how account, workspace and billing information is handled.

Use the export feature to keep a copy of prospect records you need. Contact us for deletion requests. Cancellation and deletion are separate actions.

Beta pricing and billing

The current Starter beta offer is shown on the pricing page. Modern Apex confirms the plan, price, billing schedule and any additional order terms before paid access begins. Viewing the tour or requesting access does not authorize a payment.

Assisted beta payments are collected by QuickBooks invoice. Paid workspace access is activated after payment verification. Any recurring payment authorization is handled separately through the billing arrangement you accept. Provider usage charges are separate from the workspace subscription.

Contact Modern Apex about billing errors or refund requests. Any applicable refund terms are confirmed with your beta order, subject to rights that cannot be excluded by law.

Cancellation

Request cancellation from workspace billing settings or by emailing Modern Apex. A request is recorded for review. It does not itself stop a QuickBooks recurring invoice or payment schedule. We confirm the effective date after the actual schedule is stopped. Keep that confirmation with your billing records.

The recorded paid-through period determines paid feature access. A verified refund, reversal or unpaid period may affect that access. Prospect export remains available to authenticated accounts after trial or paid access expires, subject to account security restrictions.

Product rights and feedback

Modern Apex and its licensors retain rights in the software, brand, designs and product materials. Your access permits use for your internal business purposes under the agreed plan. Feedback you choose to provide may be used to improve the product.

Availability and changes

The beta is provided as available. We do not promise uninterrupted service, a particular business result or that third-party providers will remain available. Access may be restricted to respond to misuse, security problems or unpaid service periods.

We may update the product and these terms. Changes to the terms will be reflected in the date above. Any material change to an agreed paid order must be addressed through that billing arrangement. These terms do not limit rights that applicable law does not permit us to exclude.
